Scope: These Terms of Service govern your access to and use of AgenticWay Solutions LLC's website and services. By accessing agenticwaysolutions.tech or submitting an intake form, you agree to these Terms.
By accessing or using any part of agenticwaysolutions.tech (the "Site") or submitting an intake form, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and all applicable laws. If you do not agree, do not use the Site.
AgenticWay Solutions LLC ("AgenticWay", "Company", "we", "us") is a California limited liability company operating as an Agentic IT Consulting Firm specializing in AI infrastructure, compliance automation, and digital identity protection. AgenticWay provides technology consulting, software infrastructure, and AI platform services. The Company does not provide legal advice, legal counsel, securities brokerage, investment advisory services, or licensed accounting services. All technical outputs constitute technology services only.
AgenticWay offers the following service verticals, subject to execution of a Master Services Agreement and Statement of Work:
Payments, Billing, and Subscriptions: All payments processed through the Site for Service Level Agreements (SLAs) are non-refundable and automatically recurring. By initiating a subscription via the website, the client is automatically agreeing to the core terms of the forthcoming Master Services Agreement (MSA).
All content on the Site including text, graphics, logos, service names, system architectures, and methodologies is the exclusive property of AgenticWay Solutions LLC and is protected by federal copyright, trademark, and trade secret law. The names "AgenticWay," "AgenticWay Solutions," "Algorithmic Integrity Vault," and "Insulated Logic" are claimed trademarks (TM) of AgenticWay Solutions LLC. You may not reproduce, distribute, modify, or create derivative works from any Site content without the prior written consent of AgenticWay Solutions LLC.
Information submitted through the Site's intake form is governed by the AgenticWay Privacy Policy. Submission of an intake form does not create a client relationship, contract, or obligation on the part of AgenticWay Solutions LLC. A client relationship is established only upon execution of a signed Master Services Agreement.
THE SITE AND ALL INFORMATION CONTAINED THEREIN ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AGENTICWAY SOLUTIONS LLC DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Artificial Intelligence & Human-in-the-Loop Mandate: The Services include AI-driven algorithmic routing and synthetic media verification. Artificial Intelligence is probabilistic and subject to output anomalies. To ensure regulatory safe harbor under applicable guidelines, the Client expressly agrees to retain mandatory human-in-the-loop oversight and sole operational command over all final automated responses. AgenticWay Solutions LLC shall not be held liable for any operational, financial, or reputational damages resulting from algorithmic outputs.
Data Sovereignty & CPRA Compliance: For clients utilizing our Zero-Trust computational vaults, the Client retains sole cryptographic ownership of their data. AgenticWay deploys logically isolated execution infrastructures. In compliance with the California Privacy Rights Act (CPRA), AgenticWay does not "sell" or "share" client data. If a Client compromises their own cryptographic keys or operational security, AgenticWay is fully indemnified and legally shielded from the resulting data loss or exposure.
TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, AGENTICWAY SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. THIS LIMITATION DOES NOT APPLY TO DAMAGES ARISING FROM AGENTICWAY'S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising from these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration administered by JAMS in Los Angeles County, California.
AgenticWay Solutions LLC reserves the right to modify these Terms at any time. Continued use of the Site after modifications constitutes acceptance of the revised Terms. Material changes will be noted with an updated effective date.
